Terms of Service
Article 1. Purpose
The purpose of these Terms of Service ("Terms") is to set out all matters relating to the terms of use and operation of the services provided through the HYPEWEDDING / HYPESNAP website (the "Site"), operated by HYPEPIG (the "Company").
Article 2. Definitions
The principal terms used in these Terms are defined as follows:
- "Member" means a user who has agreed to these Terms, provided personal information, registered as a Member, entered into a service agreement with the Company, and uses the Site.
- "Service Agreement" means the agreement entered into between the Site and a Member in connection with use of the Site.
- "Member ID" means a unique combination of letters and numbers assigned to each Member for the purpose of identifying Members and enabling their use of the Site's services.
- "Password" means a combination of letters and numbers chosen by a Member to confirm that the Member matches the ID assigned to them and to protect the Member's rights.
- "Company" (Operator) means the person or entity that establishes and operates the Site to provide services.
- "Termination" means a Member's cancellation of the Service Agreement.
- "Booking" means a confirmed reservation for a photography session or package, made through the Site (added for the Company's wedding photography services).
- "Content" means the photographs, galleries, and related deliverables produced or delivered as part of the Company's services (added for the Company's wedding photography services).
Article 3. Rules Other than these Terms
The Company may separately announce operating policies where necessary. If there is any conflict between these Terms and an operating policy, the operating policy shall prevail.
Article 4. Formation of the Service Agreement
The Service Agreement is formed when the Company approves the application of a person who wishes to register as a Member and agrees to the content of these Terms.
A person who wishes to register as a Member and use the Site's services expresses their agreement to these Terms by reading the Terms at the time of signing up and selecting "I Agree" below.
Article 5. Application for Service Use
A user who wishes to register as a Member and use the Site must provide all information requested by the Site (Member ID, password, nickname, and similar).
A Member who borrows another person's information or registers false information may not assert any rights in connection with use of the Site, and may be subject to punishment under relevant laws.
Article 6. Booking and Formation of the Photography Service Contract
A Booking is confirmed once the Company has accepted a Member's booking request and the Member has completed the required payment (in full or as a deposit) in accordance with Article 7. Before confirming a Booking, the Company may request additional information reasonably necessary to provide the service (for example, wedding date, venue, and preferred photography style).
Article 7. Delivery of Photographs and Copyright/Usage Rights
Upon full payment, the Company delivers the agreed photographs to the Member in the agreed format. Copyright in the photographs is owned by the Company as the creator, and the Member is granted a license to use the delivered photographs for personal, non-commercial purposes.
Separately, the Company's use of a Member's wedding photographs for its own portfolio, marketing, or social media is governed by the photo release consent described in the Company's Privacy Policy, and requires the Member's explicit agreement.
Article 8. Privacy Policy
- The Site and the Company do not hold the password included in the personal information provided at Member registration; matters relating to this are governed by the Site's Privacy Policy.
- The Company endeavors to protect Members' personal information, including registration information, as required by relevant laws and regulations.
- Matters concerning the protection of Members' personal information are governed by the relevant laws and by the Privacy Policy established by the Site.
- However, the Company is not responsible for information exposed due to a Member's own fault.
- The Company may restrict or remove postings that violate public morals or the law, and may submit a Member's records to a relevant authority for review or as data, upon a lawful request from that authority.
Article 9. Obligations of the Company
Where an opinion or complaint raised by a Member is found to be reasonable, the Company will process it as promptly as possible. Where prompt processing is difficult for practical reasons, the Company will notify the Member afterward, or contact the Member by email or other means, and make its best efforts.
The Company will promptly repair or restore any equipment failure or loss that arises, so as to provide the Site continuously and stably. However, the Company may temporarily suspend operation of the Site in the event of a natural disaster or other unavoidable reason attributable to the Company.
Article 10. Obligations of Members
- Members must comply with matters set out in these Terms and with rules, notices, and operating policies announced by the Company, and must not engage in conduct that interferes with the Company's business or damages the Site's reputation.
- Members may not assign, donate, or provide as security their right to use the Site or any other status under the Service Agreement to a third party, without the Site's express consent.
- Members must exercise reasonable care in managing their ID and password, and must not allow a third party to use their ID or password with the Company's or the Site's consent.
- Members must not infringe the intellectual property rights of the Company, the Site, or any third party.
Article 11. Hours of Service
In principle, the Site's services are available 24 hours a day, 365 days a year, unless there is a particular obstacle related to business or technical matters. However, the Site may temporarily suspend the service at a date or time it determines, for regular inspection, expansion, or replacement of systems; where possible, this will be announced in advance on the Site's homepage.
However, the Site may suspend the service temporarily or permanently, without prior notice, in any of the following cases:
- An urgent system inspection, expansion, replacement, breakdown, or malfunction occurs
- There is a national emergency, power outage, or other force majeure reason
- A telecommunications carrier designated under the relevant law suspends its telecommunications services
- There is a genuine reason to suspend service due to congestion in service use or similar circumstances
In the event of a suspension for the reasons above, the Site will notify Members in advance where possible; where advance notice is not possible due to reasons beyond the Site's control, notice will be given afterward.
Article 12. Termination of Service Use
A Member who wishes to terminate the Service Agreement with the Site must apply for termination online, in person. Termination of the Service Agreement is separate from, and must be requested independently of, termination of any individual Booking.
Upon a termination request, the Site-provided membership management program will automatically delete the Member's information from the membership management screen, and the Company will no longer be able to view that former Member's information, subject to any retention required by law or by the Privacy Policy.
Article 13. Restriction of Service Use
A Member must not engage in any of the following. Where a Member does so, the Site may restrict that Member's use of the service and take lawful measures, including terminating the Service Agreement or suspending the service for a set period:
- Registering false information when applying for membership or when later changing information
- Interfering with another person's use of the Site, or stealing another person's information
- Impersonating the Site's management, an employee, or a related party
- Infringing the personal rights or intellectual property rights of the Site or a third party, or interfering with their business
- Improperly using another Member's ID
- Collecting, storing, or disclosing another Member's personal information without that Member's consent
- An act that is objectively determined to be connected with a crime
- Any other act that violates relevant laws and regulations
Article 14. Management of Postings
Responsibility for managing and operating postings and materials on the Site rests with the Company. The Company will regularly monitor postings and materials, and where it discovers or is notified of an offending posting or material, it will delete it and give notice to the Member who posted it.
However, a Member is responsible for their own postings, and must not post content that violates these Terms on their own initiative.
Where a public authority, such as the Korea Communications Standards Commission, requests correction, the Company may delete or move a posting without the Member's prior consent.
A posting or material is judged to be offending where it:
- Severely insults or damages the reputation of another Member or a third party
- Disseminates content that violates public order or public morals, or links to such content
- Illegally reproduces or encourages hacking
- Is an advertisement made for profit
- Is objectively determined to be connected with a crime
- Infringes the copyright or other rights of another user or a third party
- Is otherwise determined to violate relevant laws and regulations
The Site and the Company may temporarily suspend (or suspend prior to disclosure) a posting where they receive a request from a third party to stop disclosure on grounds of defamation, infringement of intellectual property, or similar, until the matter is resolved through litigation, settlement, or a decision of a relevant authority.
Article 15. Storage of Postings
Where the Company must discontinue the Site for an unavoidable reason, it will make every effort to give Members advance notice and to make it easy for them to transfer or back up their postings.
Article 16. Copyright of Postings
Copyright in a posting that a Member has posted on the Site belongs to that posting Member. The Site may not commercially use a posting without the posting Member's consent, except for non-commercial purposes, and retains the right to use the posting within the service.
A Member must not use information obtained through use of the Site to reprocess or sell it commercially, or otherwise use it for a purpose other than the one for which the Member is using the Site, without prior consent.
Where the Company determines that content a Member has posted or registered on the Site falls under any of the criteria in Article 16, it may delete, move, or refuse to register the content without prior notice.
Article 17. Damages
Civil and criminal liability for any damage arising in connection with the Site rests primarily with the Member concerned.
The Company is not liable to compensate for damage suffered by a Member due to force majeure, or due to the Member's own intent or negligence.
Article 18. Disclaimer
- The Company is exempted from liability for damage arising from a Member's failure to obtain an expected benefit from the Site's services, or from a Member's own choice or use of service materials.
- The Company is exempted from liability for damage arising from a failure of the Site's service infrastructure or of another telecommunications carrier's service; damage related to the Site's own service infrastructure is governed by these Terms.
- The Company is not liable in connection with a Member's storage, posting, or transmission of materials.
- The Company is not liable for a service disruption arising from a reason attributable to the Member.
- The Company is not liable for any activity between Members, or between a Member and a third party, that occurs outside the official scope of the service (including community-type activity).
- The Company is not liable for the truthfulness, reliability, or accuracy of materials posted or transmitted by a Member, or made available to a Member through the Site.
- The Company is not liable for any transaction of goods or similar matters mediated between Members, or between a Member and a third party, through the service.
- The Company is not liable for a dispute arising between Members, or between a Member and a third party, without fault on the Company's part.
- The Company is not liable for a system fault arising during server management, inspection, or replacement, or during the operation of software, in the absence of intentional or grossly negligent conduct by the Company, nor for a system fault caused by a third-party attack, nor for damage from a computer virus or similar whose distribution or infection method has not yet been identified by a recognized security research or response organization and could not have been prevented despite the Company's response measures.
Supplementary Provision
These Terms take effect from the date the Site is launched.
